Any negotiations and discussions within Mediation are treated on a without prejudice basis and the Courts will not take such discussions into consideration should the matter proceed to litigation..
The Court, on the application of any of the parties or of its own motion, may, when it considers it appropriate and having regard to all the circumstances direct the parties to consider engaging in Mediation.
